How Long Do I Have to Wait To Get A League City Divorce?

Yes.  But Be Sure It Is Worth It.

 Either party in a League City divorce suit may demand a jury trial . As with other types of suits to terminate the marriage, a jury trial is rarely demanded to contest the grounds for divorce itself. Usually a jury request suggests that one or both parties wishes a jury decision on related issues such as property valuation or child custody jury decisions which are binding on the judge include :
  • the appointment of sole or joint managing conservatorship
  • possessory conservatorships
  • which joint managing conservator has the exclusive right to designate the primary residence of the child
  • whether a geographic restrictions should be imposed on the child's primary residence and if so, a determination of the area of restriction
Although property division is discretionary with the judge, jury findings as to the characterization and valuation of property are binding on the trial court.

No jury trial is permitted in civil cases unless a written request for a jury trial is filed with the court and a jury fee is paid. The request and fee must be requested and paid he reasonable time before the trial date, but not less than 30 days before trial . Failure to timely make this request will waive the right to a jury trial.

The decision to file a jury fee is not one to be taken lately . There may be specific strategic reasons why you should request your divorce to be heard by a jury , but unless there is a purposeful and compelling reason to request a jury, it is usually advisable in most League City divorce cases to allow the matter to be heard by the presiding judge . Not least among these considerations is the high cost of preparing a case for a jury presentation .
