What Are The Residency Requirements To File A League City Divorce?

You Have to File In the Right Place

 Before you can file for divorce you have to first be sure that you are filing in the right Court.  You have to file in the court that has "jurisdiction"- or authority to grant orders over the people and things involved in a divorce. If you are involved in a League City Divorce, residency requirements are met if either the petitioner or the respondent has been a domiciliary of Texas for the six months and resident of either Harris or Galveston county for 90 days preceding the filing a petition. Some people think that owning property in Galveston or Harris county meets the requirement.  However, mere ownership of real property without physical presence or other significant connection to Texas will not satisfy the residency requirement. However a petitioner does not lose the right to maintain a divorce suit in Galveston or Harris County if he has been temporarily absent from the county during the 90-day period. A domiciliary does not lose his domicile if he is absent from Texas for military service or other Public Service of the state or Nation or while accompanying his spouse who is on such service.  A person not previously a resident of Texas who is serving in the armed forces of the United States and has been stationed at one or more military installations in Texas for at least the last six months and a military installation in a Texas county for at least the last 90 days, or who is accompanying his spouse during the spouse's military service in those locations and for those periods, is considered to have been a domiciliary of Texas and a resident of the county for the purposes of bringing divorce suit. If one spouse has been a domiciliary of Texas for at least the last six months, and has lived in Galveston or Harris County, a spouse domiciled in another state or Nation can file a suit for divorce in the Texas County which the other spouse resides at the time the petition is filed.
